Afghanistan

We traveled through Afghanistan in the summer of 2003 and have researched the legal history of the country, although we have not published this work nor participated in the debate about legal reform in the country. In our view this is best left to the Afghan people.

We began a Freedom of Information Act case for transcripts of enemy combatant review panels of proceedings held at the Bagram prison just outside of Kabul. We have not proceeded with this case due to our concern over search and copying fees that the Dept of Defense will want to charge for the records. Nevertheless, it is vital that the world know what's going on in this secret prison and that the prisoners obtain legal representation. We are looking for a sponsor for this project, which would ideally be a news organization entitled to a waiver of fees.

The war in Afghanistan will be a long one. The history of Afghanistan suggests that the Afghan people will not accept foreign occupation, nor will they accept laws and systems of government foreign to them. See the Historical Research section on the left for more information.
